Secession and self-determination – Remedial Right Only Theory scrutinised
نویسنده
چکیده
This paper analyses to what extent a 'remedial right' to secession, as suggested by Allen Buchanan's Remedial Right Only Theory, would be suitable for regulating secession of substate entities on an international platform. In doing so it will be argued that a number of problems would have to be addressed and ambiguities removed for a ‘remedial right’ to be realisable: firstly, the entity which should be the bearer of such a right will be identified, while arguing in line with a number of scholars advocating the limitation of the right to nations. Secondly, although agreeing with Buchanan on the limitation of justified secession to exceptional circumstances, the paper will scrutinise the criteria on which legitimate secession could be based by arguing that a restriction of these to the experience of injustices, as suggested by Buchanan, is too narrow and ambiguous. Finally, while finding that an international regulation of secession would rely on strong institutions, it will be argued that the potential for reforming contemporary international bodies to fulfil this task seems limited.

Theories of Secession
All theories of the right to secede either understand the right as a remedial right only or also recognize a primary right to secede. By a right in this context is meant a general, not a special, right (one generated through promising, contract, or some special relationship). Remedial Right Only Theories assert that a group has a general right to secede if and only if it has suffered certain in...

When Woodrow Wilson advanced the principle of self-determination in a series of speeches in 1918–19, his assumption seemed to be that acknowledging the claims of self-determination was a simple corollary of respect for democracy. Contemporary secessionists, and many who write and theorize about secession, share Wilson’s intuition about this. It is widely claimed that a ‘people’ has the right to...

As we enter the 21st century, self-determinism is in the air. Most recently in July of 2011 when the newly formed state of South Sudan seceded from Sudan as a result of a territorial dispute in which a group of citizens challenged and denied the authority of the central government in their region. Self-determinism as a goal is manifest in secession. Secession is not only a division of one peopl...

First, I argue that one particular manifestation of self-determination, that of national self-determination, is both a solution to the enduring problem of territorial legitimation in international relations as well as the source of subsequent challenges to ter...
